Shoppers Terms

It is the Shoppers responsibility to ensure:

  1. Item(s), included in the service transaction do not consist of cash, illegal, any prohibited Item(s), and that the (if applicable) Item(s) can be imported or taken into the shopper’s country lawfully from the country that the Traveller is buying from.
    • ShopTrav reserves the right to cancel any transaction that is found to be in contradiction to any of its aforementioned rules. The responsibility lies with the Shopper, and necessary due diligence is expected from the Shopper before accepting any “Offer” from a Traveller and concluding an Order for any Item(s).
  2. The All-in consideration price set for the Item(s) by the Traveller is in cognizance of applicable taxes, customs duties, and any other relevant cost that might fairly be incurred in obtaining the said Item(s) by the Traveller.
  3. The Shopper fully complies with all payments regarding ShopTrav’s commission of 7-12%, based on the price of the order.
    • This commission includes the Payment Service Provider’s fee of approximately 3%.
  4. Payments for any Customs, Duties, VAT, or other similar charges are to be paid by the Traveller at the point of entry into any destination, if applicable.
    • ShopTrav recommends and prefers that the Shoppers and the Travellers to agree how these charges will be reimbursed to the Traveller. This can be done in one of the two following ways;
      • If both the Shopper and the Traveller have agreed that these charges will be part of the ‘Traveller’s Fee’ paid by the Shopper, no further action is required.
      • If both the Shopper and the Traveller agree that the Shopper will reimburse the Traveller if any charges are actually incurred by the Traveller, the Shopper may do that in cash upon receiving the payment receipt of original charges from the Traveller at the time of delivery.
      • In either case, the agreement should be clearly mentioned in the chat session between the two Users on ShopTrav’s chat platform for record as to avoid any future disputes.
        • In the event of such a Dispute, the Shopper and the Traveller are advised to leave a comment on the chat session for the purposes of creating records of the transaction.
        • If no comments are left by the Shopper or the Traveller, thereby clearly stating their agreement, ShopTrav will not be able to mediate or provide amicable solution to any such situation or disputes that either of the two Parties may face.
  1. The Shopper and the Traveller are expected to discuss the terms of any VAT that could be refunded to the Traveller, and incorporate it into the agreement of the terms of their order, under normal circumstances Traveller would get the VAT refunds prior to starting the journey.
  2. If the Shopper makes a payment for an Order/Offer on ShopTrav Services, the details, which the Shopper is asked to submit, will be provided directly to our Payment Provider via a secured connection in order to fully complete payment, including full credit card details, names and other necessary information which are required by ShopTrav Services for the transaction to proceed.
    • The cardholder must keep a copy of transaction records as per any merchant policies and rules.
  3. It is the responsibility of the Shopper to make sure that all proposed transactions and the details on the Offer screen are accurate before accepting an Offer.
    • The Shopper will be liable for any negligence or omission to confirm this fact.
  4. Amounts will be charged to the Shopper’s credit card or payment method after the Shopper clicks “Accept” on the Travellers “Offer”.
    • Accepting an offer signifies the Traveller’s indication and willingness to perform the transaction on the terms specified in the Offer.
    • By accepting the “Offer”, all the “Offers” terms are accepted by the Shopper, thus conveying the Shopper’s agreement to pay the consideration stipulated in the “Offer” for the Item(s) contained within the “Offer”.
    • PIN Code: Once the Shopper’s credit card has been charged, ShopTrav will hold funds in an account until the time of the delivery, which is when the Shopper accepts the delivery. When the Shopper has received the Item(s), the Shopper shall use the provided option to generate a PIN code specific to the particular Order. The PIN code is important and needs to be noted by the Shopper and kept confidential, as it is to be conveyed to the Traveller at the time of receiving the Item(s), to conclude the service being provided by the Traveller.
    • It is also the Traveller’s responsibility to keep proper paper records of all transactions and associated expenses conducted in association with bringing the Item(s) ordered to the destination of the Shopper. These include, but are not limited to, receipts of purchase of Item(s) and receipts for any associated ancillary expenses, etc.
  5. The Traveller will hand over the Item(s) procured under the “Offer” made to the Shopper, along with all original and relevant receipts, and the Shopper will provide the Traveller with a PIN code.
    • Once the Shopper has conveyed the PIN code for the transaction, generated by his/her ShopTrav account, to the Traveller, it indicates:
    • The Shopper has received the Item(s) in good condition and has absolved the Traveller of any future liability.
    • The Shopper has also received a proper copy of any necessary paper records from the Traveller, such as purchase receipts or any other documents mutually agreed upon between the two parties at the time of the formation of the agreement between the two.
    • Any associated risks or rewards in future from the possession of the Item(s) lie with the Shopper.
    • With the confirmation of the PIN code and its submission on ShopTrav Service Platforms, the payout procedure to the Traveller will begin.
    • The Traveller is advised to enter the PIN code in front of the Shopper and to make sure that the pin code matches. It is important for the Traveller to do so to receive his or her payments.
  6. By making available any Content or Offer on or through the Website, Application and Services, you hereby grant to ShopTrav a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such User Content on, though, or by means of the Website, Application, Products and Services.

Ownership and Risk of Loss

  1. The Traveller will retain the ownership of Item(s) until the time the Item(s) has been delivered to the Shopper. This is evidenced by the fact that the purchase receipt obtained by the Traveller when buying the Item(s) is handed over to the Shopper upon delivery.
    • Ordinary care in safeguarding the Item(s) is expected from the Travellers in procuring and delivering the Item(s) for the Shoppers.
  2. The Traveller bears any risk of loss to the item during transit.
    • Unless the loss is not a consequence of the Traveller’s negligence,
  3. In the case of a Force Majeure, the risk of any loss of Item(s), that is not due to Traveller’s negligence will be borne by the Shopper.
  4. In the event of a damaged product on delivery, the Shopper is allowed to withhold providing the PIN code and to demand a reimbursement

Limitation of Liability

  1. ShopTrav’s roles in transactions between Shoppers and Travellers are:
    • Providing the provision of the ShopTrav’s Service Platform to connect Shoppers with Travellers,
    • To facilitate the parties to voluntarily enter into the transaction on terms of their own choosing, and
    • As a payment processor and guarantor for the transactions.
  2. ShopTrav shall not be responsible for any customs or import problems that may arise from a transaction or any other agreement between a Shopper and a Traveller, or for any loss, injury, or damage that either the Shopper or the Traveller may experience in connection with or arising out of the transaction.
  3. Users are uniquely responsible for all of their interactions with other Users of the ShopTrav’ Service platforms, and with other persons with whom they interact as a result of the use of ShopTrav’s Service platforms including, but not limited to, Travellers and Shoppers.
  4. Upon Agreement between the Traveller and the Shopper, both User(s) are responsible for choosing a reasonable, mutually agreed place for the delivery of the agreed Item(s) and to end the transactions through the ShopTrav Service platform.
    • It is the responsibility of the Users to take reasonable precautionary care in all interactions with other Users of ShopTrav Service including, particularly, if they decide to meet in person or offline, irrespective of whether such a meeting were arranged on or outside of the ShopTrav Service platforms.
  5. ShopTrav will endeavor to protect the information that is provided by Users to ShopTrav. However, Users agree that submission of such information is at User’s sole discretion and risk and so, henceforth, disclaim ShopTrav of any and all liability and damages whatsoever conceivable attached to the information provided in all arrangements.
  6. ShopTrav Shoppers are currently allowed within the following regions;
    • United Arab Emirates
    • Egypt
    • Pakistan
  7. ShopTrav recommends that Travellers do not settle cash transactions with Shoppers. The Traveller shall take the onus of paying the duties and charges during the “Offer” and settle them as part of the total consideration paid by the Shopper on ShopTrav’s Service Platforms.
